This matter comes before the court on the Petition of David Goldstein on Appeal of Ballot Title and Summary for Initiative 831 and on the counterclaim filed by the Respondent Attorney General Gregoire. The court has considered the Petition, the Counterclaim, and the other pleadings and records on file in this matter. NOW, THEREFORE, IT IS HEREBY ORDERED 1. The ballot title and summary for I-831 shall be as follows: BALLOT TITLE
Statement of Subject:
Initiative 831 would proclaim Tim Eyman a horse's ass.
Concise Description:
This measure, if enacted by the people of the State of Washington, would proclaim that Tim Eyman is a horse's ass, for reasons which are stated in the whereas clauses of the initiative.
Should this measure be enacted into law? Yes [ ] No [ ]
BALLOT MEASURE SUMMARY
This measure states in whereas clauses that Tim Eyman has sponsored irresponsible tax initiatives, diverted money from initiative campaigns to himself and his corporation, and admitted "I just feel like an ass." The measure contains a resolution that "Tim Eyman is a horse's ass" and calls for transmittal of the resolution to Mr. Eyman, his wife, and his mother.
2. Respondent's "counterclaim" is dismissed without prejudice and without award of costs to either party. The clerk is directed to file a certified copy of this order with the Secretary of State.
